1. Acceptance of Terms
By accessing or using Pickleball Now ("Pickleball Now," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Services.
2. Description of Services
Pickleball Now provides tools that allow users to discover courts, communicate with other players, create and join activities, groups, leagues, tournaments, and events, track pickleball-related information, and contribute community content.
3. Eligibility
You must be at least 13 years old to use the Services. If you are under the age of majority in your jurisdiction, you may use the Services only with permission from a parent or legal guardian.
4. User Accounts
You are responsible for maintaining the confidentiality of your account and for all activity occurring under your account.
You agree to provide accurate information and keep your account information current.
We reserve the right to suspend or terminate accounts that violate these Terms.
5. User Content
Users may submit content including profiles, court information, comments, messages, photos, reviews, league information, activity information, and other content ("User Content").
You retain ownership of your User Content.
By submitting User Content, you grant Pickleball Now a worldwide, non-exclusive, royalty-free, transferable license to use, host, store, reproduce, modify, display, distribute, and publish such content for operating, improving, promoting, and providing the Services.
You represent that you own or have the necessary rights to submit User Content.
6. User Conduct
You agree not to:
- Violate any law or regulation.
- Harass, threaten, stalk, or abuse other users.
- Submit false, misleading, or fraudulent information.
- Upload unlawful, defamatory, obscene, or infringing content.
- Attempt to interfere with the security or operation of the Services.
- Collect user information without authorization.
- Impersonate another person or entity.
7. Activities, Events, Groups, and Leagues
Groups, leagues, activities, tournaments, events, gatherings, and meetups available through the Services are created, organized, and managed by users or third parties.
Pickleball Now does not organize, host, supervise, monitor, control, endorse, inspect, or guarantee any event, activity, organizer, participant, venue, or facility.
Participation in any activity is entirely voluntary and at your own risk.
8. Assumption of Risk
Participation in pickleball, sports activities, tournaments, leagues, meetups, social gatherings, and related activities involves inherent risks, including property damage, personal injury, illness, disability, and death.
You voluntarily assume all risks associated with participation in any activity discovered, organized, or facilitated through the Services.
9. User Interactions
You are solely responsible for your interactions with other users.
Pickleball Now does not perform criminal background checks, identity verification, or screening of users.
We make no representations regarding the identity, conduct, intentions, safety, qualifications, or reputation of any user.
10. Venue and Court Information
Court information, hours, availability, amenities, and other venue information may be provided by users or third parties.
We do not guarantee that any information within the Services is accurate, current, complete, or suitable for your purposes.
Always verify venue information independently.
11. Safety
You are solely responsible for exercising appropriate caution when interacting with others or attending activities.
Pickleball Now recommends meeting in public places, informing others of your plans, and exercising reasonable judgment.
12. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason.
13. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PICKLEBALL NOW DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND AVAILABILITY.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PICKLEBALL NOW, ITS OWNERS, AFFILIATES, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
15. Release
To the fullest extent permitted by law, you release Pickleball Now and its affiliates, owners, employees, contractors, and agents from claims arising from:
- Participation in activities or events.
- Interactions with users.
- Use of courts or facilities.
- User-generated content.
- Injuries, losses, or damages arising from use of the Services.
16. Indemnification
You agree to defend, indemnify, and hold harmless Pickleball Now from any claims, liabilities, damages, losses, judgments, costs, and expenses arising out of:
- Your use of the Services.
- Your User Content.
- Your participation in activities.
- Your violation of these Terms.
- Your violation of any law or third-party rights.
17. Changes to Terms
We may update these Terms at any time. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
